Terms of Service

The rules governing Altox Cloud accounts, services, billing, responsible use and service-specific conditions.

Overview

These Terms of Service ("Terms") form an agreement between you ("User", "Customer", "Client") and Altox ("Company", "we", "our", "us"). They govern your use of the Altox Cloud website, client area, APIs, servers, infrastructure and related services. Service-specific terms shown at checkout or in the client area may add to these Terms.

By registering, purchasing or using a service, you agree to these Terms, the applicable Privacy Policy, Acceptable Use Policy, Refund Policy and any service-specific conditions presented before purchase. If you do not agree, discontinue use.

1. Eligibility

You must be at least 14 years old or the minimum legal age required in your jurisdiction, whichever is higher. If you act for a business or organization, you confirm that you have authority to bind it. Altox may request reasonable verification where required for security, fraud prevention or legal compliance.

2. Account registration and security

Provide accurate, complete and current information. Do not use false identities or misleading details. Do not create accounts to bypass limits or enforcement. You are responsible for protecting credentials and for activity conducted through your account, subject to applicable law.

3. Services

Altox Cloud may provide VPS hosting, Windows Server RDP, dedicated IP services and other infrastructure or add-ons offered through the current client area. Availability, pricing, specifications, resource limits and support scope are determined by the applicable product page or order. Static website pages are informational and are not a guarantee that a product is available at a particular price or configuration.

4. Free services

Where a free service is offered, it is provided at Altox's discretion and may have different resource, support, retention and availability conditions. Unless a written service description says otherwise, free services do not carry a commercial uptime, backup or SLA commitment. Inactivity, abuse, excessive resource consumption or policy violations may lead to suspension or removal.

Prohibited uses include crypto mining where not expressly permitted, abusive file storage, unauthorized proxy or VPN operation, pirated software, adult content where prohibited by the applicable service, sustained abusive CPU workloads and automated activity that harms shared infrastructure.

5. Paid services

Paid services are generally prepaid and begin after payment and provisioning requirements are satisfied. Resource limits must be respected. Prices and service configurations may change for future orders or renewals with reasonable notice where required. Paying for a service does not transfer ownership of Altox or upstream infrastructure.

6. VPS and administrative access

If a service includes root or administrative access, you are responsible for operating-system updates, application security, credentials, firewall configuration and the software you install. Altox does not provide system administration unless that support is expressly included or purchased. A compromised or misconfigured server may be restricted when necessary to protect other systems or the network.

7. Billing and account management

You are responsible for monitoring active services, renewal dates, invoices, payment methods and account balances. Keep your registered email address functional and monitored. Failure to receive a reminder does not by itself cancel an invoice or renewal. Unpaid invoices may result in suspension, and data may be deleted after applicable retention periods.

Taxes, including GST where applicable, may apply. Chargebacks or payment disputes may lead to suspension while the matter is investigated. Any reactivation conditions are determined by the applicable service and billing system.

8. Refunds

Refund eligibility is governed by the published Refund Policy and any service-specific terms shown before purchase. Where a refund window exists, requests must be made through the official support channel within that window. Services specifically identified as non-refundable remain subject to those exclusions.

9. Fair use and prohibited activity

You must not use Altox infrastructure for malware, phishing, unauthorized access, botnets, DDoS-for-hire services, spam campaigns, fraud, copyright infringement, illegal content or other prohibited activity. The detailed rules are in the Acceptable Use Policy .

10. Abuse complaints and enforcement

Altox may investigate credible abuse reports and may restrict or suspend a service when reasonably necessary to address active abuse, security threats, legal requirements or material policy violations. Customers should respond promptly to abuse notices and provide relevant information without disclosing unnecessary credentials.

11. Staff conduct

Customers must communicate with staff in a professional manner. Threats, targeted harassment, discriminatory slurs, credible threats of violence or abusive conduct may result in restrictions on support access and, where warranted by the circumstances and applicable law, suspension or termination.

12. Backups and data

Unless a service description expressly states otherwise, you are responsible for maintaining independent backups of important data. Hosting infrastructure should not be treated as the only copy of critical information. Backup, snapshot and restoration availability depends on the purchased service.

13. Service-level commitments

An SLA applies only to services or plans that expressly include one. The current Service Level Agreement describes the measurement method, exclusions and service-credit process. Marketing or technical pages that do not incorporate an SLA should not be interpreted as a separate uptime guarantee.

14. Dedicated IP services

IP addresses may remain the property of Altox or an upstream provider. Allocation is subject to availability and network policy. IPs may be withdrawn or replaced where required for security, abuse response, provider requirements or legal compliance, subject to applicable service terms.

15. Reselling and affiliates

Reselling Altox infrastructure requires written authorization where the applicable product says so. Affiliate activity must be genuine; self-referrals, fraud and manipulation may result in commission reversal or account termination.

16. Intellectual property

Altox branding, original website content and Altox-owned software remain the property of their respective owners. Third-party trademarks, software and content remain subject to their own licenses and terms. Nothing in these Terms grants a broader intellectual-property license than is expressly stated.

17. Limitation of liability

To the maximum extent permitted by applicable law, Altox will not be liable for indirect, incidental, special or consequential losses. Any contractual liability cap, if applicable, is subject to mandatory consumer protections and the specific service agreement or order. Nothing here excludes liability that cannot lawfully be excluded.

18. Indemnification

To the extent permitted by law, you agree to be responsible for claims, losses and reasonable costs arising from your unlawful use of the services, your violation of these Terms or your infringement of third-party rights.

19. Force majeure

Altox is not responsible for delays caused by events reasonably outside its control, such as natural disasters, war, governmental action, major utility failures or upstream infrastructure outages, subject to applicable law and any service-specific SLA.

20. Suspension and termination

Services may be suspended or terminated for non-payment, material policy violations, fraud, active security threats or legal requirements. Where circumstances permit, Altox may provide notice and an opportunity to remedy. Critical security or legal situations may require immediate action.

21. Severability

If a provision is found unenforceable, the remaining provisions remain effective to the extent permitted by law.

22. Entire agreement and updates

These Terms, together with applicable policies, order terms and service-specific conditions, form the agreement governing the relevant service. Altox may update website policies when its services, systems or legal obligations change. The effective version should be reviewed before continued use or purchase.
